Tariff Card (Terms & Conditions)

1.	The Printers (Mysore) Pvt. Ltd. (hereinafter called the Company) shall have absolute discretion to omit or suspend or change the positioin or the scheduled date of publication of any advertisement accepted for insertion.

2.	The Company shall have the right to tmake any change/ alteration they consider necessary or desirable in any advertisement to meet their requirement.

The Company shall not be liable to any person for any loss or damage or costs of claims or actions or proceedings arising out of or caused by an error or inaccuracy in the printing of or omission to insert any advertisement or for any damage out of blocks or drawings or other material supplied for purpose of advertising.

4.	The Company shall accept no responsibility for faulty printing due to defective material supplied or due to circumstances beyond their control.

While every endeavour will be made by the company to avoid publication of competitive advertisements in close proximity to each other, no guarantee can be given in this respect, nor will claims be entertained for free insertions in the event of two competitive advertisements appearing on the same page.

6.	The company reserves the right to decline publication of copy or illustration which would, in their opinion desfugure the paper or prejudice adjoining or other advertisements in the same issue as also to refuse or suspend publication of any advertisement, without assigning any reason.
7.	The company shall not be responsible in any manner for failure to publish advertisements, the copy and instructions of which are not received as stipulated in the Tariff Card.
8.	The Company shall not be bound by notice or stop order, cancellation or transfer of advertisements booked for insertion in special or specified position received less than three days in case of dailies and four weeks in case of weeklies or two months in the case of monthlies prior to the date of insertion for advertisement in run off paper or in special or specified position.

9.	The Advertising Agency or Advertiser submitting the Advertisement shall fully indemnify the company in respect of any loss or damage, costs or claims, actions or proceedings including the expenses incurred for defending the same arising against them from the publication of the advertisement published in accordance with the terms conditions contained herein. In case where a claim is made against the company and the Advertising Agency or Advertiser may ultimately be liable under the terms hereof notice in writing shall be given to hIm by the Company by certificate of posting to the address given by the said Advertising Agency or Advertiser at the time of Submitting the advertisement which shall be deemed to be sufficient notice in order to enable consultations to be held before any expense is incurred or the claim is settled or otherwise disposed of to his detriment.
10.	It is understood that any release order placed by the agency constitutes a warranty by the Advertising Agency to the newspaper that the said Agency has secured all necessary authority or permission in respect of the use in the advertisements of pictorial representation of (or purporting to be of) living persons and all references to and words attributed to living persons and that it has been duly authorised by the advertiser.
11.	The Placing of an order for the insertion of an advertisement shall amount to an acceptance of the above conditions which alone shall govern the contracts between the Company and The Advertising Agency or Advertiser as the case may be.
12.	All disputes and differences arising between the parties under contract shall be referred to Arbitration as per the Arbitration and Reconciliation Act 1996 and subject to the jurisdiction of the Civil Courts at Bangalore only.
13.	The Proprietor, THE PRINTERS (MYSORE) PRIVATE LIMITED reserves the right to refuse any advertisement even after cash has been received and a receipt given.
