  1. Ironically, by enabling citizen lawsuits, the amendment could hamper the rollout of zero-carbon energy infrastructure in NY. Wind/solar projects already face a lot of NIMBY lawsuits. This measure could open the floodgates, potentially delaying projects for years.

  2. If interpreted broadly by courts, the measure would move key environmental decisions away from legislature and regulators and into the courts, which are ill-equipped to deal with such decisions. The result could be "vigilante regulation through litigation."

  3. Prop 2 on the NY ballot in Nov is the so-called Green Amendment, giving New Yorkers "a right to clean air and water and healthful environment." Sounds great in theory. But the measure's deliberately vague language could threaten legal chaos:

    this is a silly take because: - we will need energy *forever* and our needs will probably keep increasing - nuclear plants are being built in less than 10 years right now - renewables + batteries are pretty expensive too - I thought climate change was an existential threat?

    This pandemic could’ve started because scientists decided to insert a novel cleavage site into a weak novel SARS-like virus. Not knowing it would generate a pathogen with pandemic potential. We cannot be ok with labs globally experimenting with pathogens without transparency.

    See also this recent review by on the specific regulations like ALARA that artificially retarded nuclear energy in the US. TLDR: if nuclear was cheaper than another energy source, regulators claimed you weren’t spending enough on safety.
